Give Unity - Terms and Conditions and Privacy Policy

Welcome to Give Unity ("Platform" or "App"). These Terms and Conditions (“Terms”) govern the use of the Give Unity platform, accessible via mobile application and website. By using this platform, you agree to comply with these terms.

 

1. Definitions

  • “Platform”: Refers to the Give Unity app and website, including all associated content, services, and features.

  • “User”: Refers to individuals who use the platform to donate funds or engage in activities related to charitable giving.

  • “NGO”, "Organisation" or "Impact Partner": Refers to non-profit organizations registered on the platform that receive donations. Terms may be used interchangeably. 

  • “Donation”: A financial contribution made by a User to an NGO.

  • “POPIA”: The Protection of Personal Information Act, South Africa’s data privacy legislation.

  • “Section 18A Certificate”: A tax certificate issued by an NGO in terms of Section 18A of the South African Income Tax Act, enabling a donor to claim a tax deduction on eligible donations.

 

2. Acceptance of Terms

By accessing or using Give Unity, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to the Terms, please refrain from using the platform.

 

3. User Accounts

  1. Account Creation: Users must create an account to make donations. Impact Partners must undergo a verification and approval process to be onboarded as registered non-profits on the platform.

  2. Age Requirement: Users must be at least 18 years old to create an account and use our services. By creating an account, users warrants that they meet this age requirement.

  3. Monitoring and Review: Give Unity reserves the right to monitor and review user accounts. We may suspend or terminate accounts that violate these Terms and Conditions or our community guidelines.

 

4. Donations

  1. Users can donate to registered NGOs via the platform.

  2. All donations are processed through secure third-party payment processors.

  3. Give Unity does not process refunds once a donation has been made. Refunds for donations are at the sole discretion of the recipient NGO.

 

5. Section 18A Certificates

  1. Where applicable, Impact Partners may issue Section 18A tax certificates for donations that qualify for tax deductions.

  2. Give Unity is not responsible for issuing tax certificates but facilitates the process through the platform.

  3. NGOs are solely responsible for ensuring compliance with all tax regulations, including the issuance of accurate Section 18A certificates.

  4. Give Unity shall not be liable for any errors in tax certificate issuance.

 

6. Privacy and Data Protection (POPIA Compliance)

We respect your privacy and are committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA).

Key Points:

  • Data Collection: We collect personal information, provided by you, such as your name, email, and payment details to provide services. 

  • Purpose: Personal data is collected solely for processing donations, providing services, issuing tax certificates, and communication.

  • Third-Party Sharing: We do not sell or rent your personal information to third parties. Information may be shared with Impact Partners (NGOs) or payment processors as required.

  • Data Security: We implement industry-standard security measures to protect personal data.

  • User Rights: Users have the right to access, correct, or delete their data as stipulated by the POPIA Act.

 

7. Security of Information

Give Unity employs appropriate security measures to safeguard user information and transactions. However, we cannot guarantee the absolute security of electronic data and transactions. Users agree to use the platform at their own risk.

 

8. Payment Processing and Fees

  1. Pricing Structure: Give Unity may charge transaction fees for processing donations made through the platform. These fees will be clearly displayed to Users and NGOs prior to completing a transaction.

  2. Transparent Fees: Any applicable fees for donation processing, service charges, or any other costs associated with using the platform will be transparently communicated.

  3. Refunds: All donations made through Give Unity are final and non-refundable, except in cases where the NGO explicitly provides a refund policy.

  4. Transaction Limitations: Give Unity reserves the right to impose limitations on the amount that can be donated per transaction, per day, or for any specific promotional campaign. Users will be notified of such limitations during the donation process.

 

9. User Conduct

Users agree to use the app in compliance with all applicable laws and regulations of the Republic of South Africa and to refrain from engaging in any conduct that could harm Give Unity or other users.

10. User-Submitted Content

  1. Content Publication: Users may publish comments, images, videos, and other content within the app.

  2. Content Monitoring: Give Unity will monitor and review user-submitted content to ensure compliance with these Terms.

  3. Rights to Use: By submitting content, users grant Give Unity the right to use, reproduce, modify, and publish the submitted content for commercial, marketing, or similar purposes.

  4. Modification and Removal: Give Unity reserves the right to modify or remove any user-submitted content at our discretion.

  5. Backup Requirement: Users are encouraged to keep backup copies of any content they submit, as Give Unity is not responsible for any loss of content.

 

11. Liability Limitation

Give Unity is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the app or the inability to use the app. Users assume all risks associated with their use of the app and its services.

 

12. Intellectual Property

All content, trademarks, and intellectual property on the platform remain the exclusive property of Give Unity and its licensors. Unauthorized use of any content is strictly prohibited.

 

13. Suspension and Termination

  1. Give Unity reserves the right to suspend or terminate a User or NGO’s account if they breach these terms or engage in fraudulent, illegal, or harmful activities.

  2. Termination of an account may result in the loss of all data associated with that account. And potential further legal action where appropriate. 

 

14. Dispute Resolution

  1. Any disputes arising out of these Terms shall be governed by South African law.

  2. Arbitration: Parties agree to submit any disputes to binding arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).

 

15. Amendments

Give Unity reserves the right to modify or update these Terms at any time. Users will be notified of significant changes through the app or via email. Continued use of the platform following such changes constitutes acceptance of the revised terms.

 

16. Severability

If any provision of these Terms is found to be illegal or unenforceable, the remaining provisions shall continue to be valid and enforceable.

 

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
